Welcome to www.TheJouleCollection.com (the “Website”). The Website is operated by Joule Experience Collection™ (“Joule,” “we,” “us,” or “our”).

These Website Terms and Conditions (“Terms”) govern your access to and use of the Website, including its content, contact forms, downloadable materials, promotional information, and other features. Please read these Terms carefully.

By accessing or using the Website, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, please do not use the Website.

1. About Joule Experience Collection

Joule designs and facilitates customized, retreat-inspired programming for luxury group travel, meetings, retreats, celebrations, and other group experiences. Programming may include facilitated conversations, creative activities, workshops, wellness-oriented experiences, group gatherings, and other curated activities led by a Joule Experience Director or another approved facilitator.

Unless expressly stated in a separate written agreement, Joule does not arrange or provide transportation, lodging, meals, admission tickets, travel insurance, destination management, or other traditional travel services.

Information presented on the Website is for general informational and promotional purposes. It does not constitute a confirmed reservation, binding proposal, or agreement to provide services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Website or submit a business inquiry.

If you use the Website on behalf of a company, organization, travel advisor, hotel, event planner, or other entity, you represent that you are authorized to act on that entity’s behalf.

The Website is not directed to children under 13. Children should not submit personal information through the Website.

3. Website Information Is Not a Booking

Submitting a contact form, requesting information, discussing a potential itinerary, or receiving preliminary materials does not create a reservation, partnership, agency relationship, or contract with Joule.

A Joule engagement is confirmed only when the applicable parties have executed a written proposal, service agreement, statement of work, booking agreement, or similar contract and any required deposit or initial payment has been received.

The terms of that separate written agreement will govern the engagement. If these Website Terms conflict with an executed written agreement, the executed written agreement will control with respect to the services covered by that agreement.

4. Proposals, Pricing, and Availability

Website descriptions, sample itineraries, workshop menus, promotional offers, and pricing references are illustrative and may be modified at any time.

Final programming, scope, staffing, dates, fees, expenses, payment schedules, cancellation terms, and deliverables will be established in a separate written agreement.

All services are subject to availability. A conversation, inquiry, proposal, or tentative hold does not guarantee the availability of an Experience Director, facilitator, program, date, or destination.

Unless otherwise stated in writing:

• Pricing may change based on group size, destination, itinerary, program scope, travel requirements, staffing, customization, and other project-specific factors.

• Travel, lodging, meals, ground transportation, venue costs, materials, local taxes, permits, and third-party expenses may be charged separately.

• Quotes and proposals expire on the date stated in the applicable document.

• Taxes, duties, processing fees, and other required charges may be added where applicable.

5. Sample Itineraries and Program Descriptions

Sample itineraries, journey themes, workshops, activities, photographs, testimonials, and program descriptions are provided to illustrate the types of experiences Joule may create.

Actual programming may differ based on the destination, venue, weather, cultural considerations, group profile, participant needs, timing, facilitator availability, safety requirements, local restrictions, and the final written scope of work.

Nothing on the Website guarantees that a particular activity, facilitator, location, itinerary element, outcome, or experience will be included in a future engagement.

6. Relationship With Travel and Event Partners

Joule may work with travel advisors, tour operators, hotels, resorts, venues, destination management companies, meeting planners, retreat planners, event professionals, and other third parties.

Unless an executed written agreement expressly states otherwise:

• Joule is not the traveler’s travel advisor, tour operator, hotel, transportation provider, insurer, or destination management company.

• Joule does not control the acts, omissions, schedules, policies, facilities, or services of third-party providers.

• Travel reservations, transportation, accommodations, meals, excursions, venue arrangements, entry requirements, and destination logistics remain the responsibility of the traveler, group organizer, contracting partner, or applicable third-party provider.

• A reference or link to a third party does not constitute a guarantee or endorsement of that party’s services.

Each third-party provider may impose its own terms, waivers, cancellation policies, and privacy practices.

7. Participant Responsibilities

Travelers and participants are responsible for determining whether a journey, activity, destination, or program is appropriate for them.

Participants are responsible for:

• Providing accurate and complete information when reasonably requested.

• Reviewing the itinerary and applicable participation requirements.

• Obtaining passports, visas, vaccinations, permits, insurance, and other required travel documentation.

• Complying with applicable laws, venue rules, cultural expectations, and safety instructions.

• Informing the appropriate organizer of relevant accessibility requirements, dietary restrictions, allergies, medical concerns, or other needs within the timeframe established for the engagement.

• Making independent decisions about whether to participate in any optional activity.

Joule may modify, pause, or discontinue an activity when reasonably necessary to protect participants, facilitators, partners, or the integrity of the experience.

8. Wellness and Personal-Development Programming

Certain Joule experiences may include reflection, mindfulness, creativity, facilitated conversation, movement, personal-development activities, or other wellness-oriented programming.

These experiences are educational and experiential. They are not medical care, mental health treatment, psychotherapy, crisis intervention, diagnosis, or individualized healthcare advice.

Participation does not create a physician-patient, therapist-client, counselor-client, fiduciary, or other healthcare relationship with Joule or its facilitators.

Participants should consult an appropriately qualified professional regarding medical, psychological, legal, financial, or other professional concerns. Anyone experiencing an emergency or immediate safety concern should contact local emergency services.

9. Accessibility and Accommodations

Joule seeks to create inclusive and thoughtfully designed experiences. However, accessibility may vary depending on the destination, property, venue, itinerary, transportation provider, and activity.

Requests for reasonable accommodations should be communicated as early as possible to the group organizer and Joule. We will work in good faith with the contracting partner and applicable providers, but we cannot guarantee that every requested accommodation will be available in every location.

10. Promotions and Special Offers

From time to time, the Website may present discounts, limited-time offers, or other promotions.

Promotions:

• Are subject to availability and any additional terms stated with the offer.

• May apply only to specified dates, services, destinations, group sizes, or booking periods.

• May not be combined with other offers unless expressly stated.

• Have no cash value.

• May be modified, suspended, or withdrawn as permitted by law.

• Do not create a confirmed booking until all stated requirements have been satisfied and a written agreement has been executed.

In the event of a conflict, the specific written terms of the promotion will control.

11. Acceptable Use

You may use the Website only for lawful purposes.

You may not:

“Joule Experience Collection,” related names, logos, program names, journey names, slogans, and brand elements are trademarks or proprietary identifiers of Joule. No license or right to use them is granted except as expressly provided in these Terms.

You may view and print limited portions of the Website for your own internal, noncommercial evaluation of Joule’s services. You may not reproduce, modify, republish, distribute, sell, license, publicly display, create derivative works from, or commercially use Website content without prior written permission.

13. Materials You Submit

When you submit an inquiry, message, testimonial, review, photograph, idea, suggestion, itinerary information, or other material through the Website or directly to Joule, you represent that:

• The information is accurate to the best of your knowledge.

• You have the right to provide it.

• Providing it does not violate another person’s rights or any contractual obligation.

Testimonials and reviews describe individual experiences. They are not guarantees that another traveler, group, planner, or partner will have the same experience or achieve a particular result.

Outcomes depend on many factors, including the group, destination, itinerary, participation, facilitation, timing, and circumstances of the engagement.

15. Third-Party Websites and Services

The Website may contain links to third-party websites, platforms, social media services, booking tools, maps, videos, or other resources.

Joule does not control and is not responsible for third-party content, security, availability, accuracy, terms, or privacy practices. Accessing a third-party website or service is at your discretion and may be subject to separate terms.

This includes loss of data, business opportunity, revenue, profits, goodwill, or other intangible losses, even if the possibility of such damages was known.

To the fullest extent permitted by law, Joule’s total liability arising from your use of the Website will not exceed one hundred U.S. dollars.

These limitations concern Website use. Liability related to contracted Joule services will be governed by the applicable written agreement.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Joule and its owners, officers, employees, contractors, facilitators, and service providers from claims, damages, liabilities, judgments, losses, and reasonable legal expenses arising from:

• Your infringement or violation of another person’s rights.

This provision does not require you to indemnify a party for conduct for which indemnification is prohibited by law.
